Social Security’s WEP and GPO Repeal — What It Means for a Florida Divorce
For years, many Florida public-sector retirees — including those with a Florida Retirement System pension — saw their Social Security benefits reduced or eliminated by two federal rules: the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO). That changed in early 2025.
What Happened
The Social Security Fairness Act repealed both WEP and GPO, retroactive to January 2024. The Social Security Administration has since issued retroactive payments to affected beneficiaries and adjusted ongoing monthly benefits. If you or your spouse worked in a job covered by a public pension — teaching, law enforcement, fire service, or other FRS-covered employment — and also has Social Security-covered work history, this repeal likely affects the numbers on the table.
Why It Matters in a Divorce
Later-life divorces often involve support and property discussions built around each spouse’s expected retirement income. An old assumption — “their pension will cancel out most of their Social Security” — is no longer accurate for anyone affected by the repeal. Using a pre-2024 benefit estimate, or an old rule of thumb, can distort a support conversation or a division-of-assets discussion built around it.
What to Do About It
Each party should confirm their current Social Security benefit estimate — through their My Social Security account or a recent SSA statement — rather than relying on an old estimate, old paperwork, or advice that predates the repeal. Questions about how a corrected benefit affects support eligibility, divorced-spouse benefits, or survivor benefits are legal and financial planning questions best directed to your attorney or a qualified financial professional.
In Mediation
This is exactly the kind of issue mediation is built to surface: a factual update that both parties need before they can meaningfully discuss support or retirement planning, identified early rather than discovered later.
