Is a Professional Degree, License, or Business a Marital Asset in Florida?
When one spouse built a career, a license, or a business during the marriage — sometimes with the other spouse’s direct support — a natural question comes up: is that career itself something to divide? Florida’s answer is more nuanced than a simple yes or no.
A Degree or License Itself Is Not Marital Property in Florida
Unlike a small number of other states, Florida does not treat a professional degree or license as a divisible asset with its own dollar value to be split.
But the Contribution Behind It Doesn’t Disappear
Florida law directs courts to consider the contribution of one spouse to the other’s career or educational opportunity — for example, working while a spouse attended school — as a factor when dividing the marital estate as a whole. It shows up in how other assets are divided or how support is structured, not as a separate line item called “the degree.”
Education Debt Is Treated Like Other Debt
Student loans or other education debt taken on before the marriage generally stay separate; debt taken on during the marriage is generally treated as marital.
A Business Is Different — and Splits into Two Pieces
If a spouse owns a business, Florida draws a line between two kinds of goodwill: enterprise goodwill, the value of the business itself independent of who runs it, and personal goodwill, the value tied specifically to that individual’s own reputation and relationships. Florida generally treats enterprise goodwill as divisible and personal goodwill as not — often the central question in valuing a professional practice, and usually requiring a qualified valuation professional.
What This Means for Mediation
A mediator doesn’t value a business, calculate a spouse’s contribution credit, or characterize goodwill. What mediation can do is help the parties agree on the practical shape of a resolution once the legal and valuation questions have answers.
